Terms of Service

These Terms of Service govern your access to and use of the Somlr mobile application, the somlr.ai website, and any related features, content, and services offered by RBLS LLC (collectively, the "Service"). By downloading, accessing, creating an account for, or using the Service, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree to these Terms, you may not use the Service. If you use the Service on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

Somlr is an AI-powered wine recommendation service designed to help users review restaurant wine lists, extract wine names and related information from images, and receive personalized wine suggestions based on stated taste preferences and other inputs.

The Service may include recommendation features, account functionality, saved favorites, scan history, and other tools that we add, modify, or remove from time to time. We may change, suspend, or discontinue any part of the Service at any time, with or without notice, as permitted by law.

To use certain features, you may be required to create an account and provide accurate, current, and complete registration information, including your email address. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You may use Somlr only if you are at least 21 years old, or the legal drinking age in your jurisdiction, whichever is higher, and legally permitted to access alcohol-related content where you are located. By using the Service, you represent and warrant that you meet these eligibility requirements.

You agree to promptly update your account information if it changes and to notify us immediately if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

Certain features of the Service require access to your device camera or photo library so that you can capture or upload images of restaurant wine lists. By using these features, you authorize Somlr and its service providers to process those images for the limited purpose of extracting text, identifying wines, and generating related recommendations or outputs.

Images submitted through the Service are transmitted to OpenAI for AI-based image and text processing. Somlr does not permanently store those photos on its own servers after processing is complete, except to the limited extent temporary retention is technically necessary for transmission, troubleshooting, security, abuse prevention, or legal compliance.

You are responsible for ensuring that you have the right to capture and upload images you submit and that such use does not violate any law, contract, venue rule, privacy right, or third-party right.

Somlr uses artificial intelligence and automated systems to generate extracted text, tasting insights, and wine recommendations. These outputs are generated algorithmically and are provided for general informational and convenience purposes only.

Somlr is not a licensed sommelier, retailer, nutritionist, physician, or other professional advisor. Recommendations may be incomplete, unavailable, inaccurate, outdated, or unsuitable for your tastes, budget, dietary needs, or circumstances. You should use your own judgment before purchasing, ordering, consuming, or relying on any recommendation.

We do not guarantee the accuracy of wine list scans, label identification, pairing suggestions, vintage information, pricing, tasting notes, or recommendation rankings.

You may submit information to the Service, including your taste profile, wine type rankings, flavor traits, reference wines, saved favorites, feedback, and other content or data you choose to provide (collectively, "User Content"). You retain any rights you may have in your User Content, subject to the rights granted in these Terms.

By submitting User Content, you grant RBLS LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, analyze, and use that User Content as necessary to operate, maintain, improve, and provide the Service and related support, analytics, and security functions.

You represent and warrant that you have all rights necessary to submit User Content and that your User Content will not violate any law or infringe the rights of any third party.

We collect and use account information, taste profile information, favorites, usage data, and related inputs to provide personalized recommendations, maintain your account, improve recommendation quality, support app functionality, and protect the Service.

We may also use aggregated and anonymized wine preference data, usage patterns, and related analytics to test, evaluate, and improve our product, recommendation systems, and user experience. We do not sell your personal information, and we do not share individual user data with third parties for their own marketing purposes.

Our data practices are described in more detail in our Privacy Policy, which is incorporated into these Terms by reference.

Somlr relies on third-party providers to operate key parts of the Service. In particular, we use OpenAI for AI processing and image-based text extraction and Supabase for cloud database and related storage services. Your use of the Service may therefore involve processing by these providers as necessary to deliver functionality.

Third-party services are governed by their own terms and privacy practices. You can review OpenAI's privacy information at https://openai.com/privacy and Supabase's privacy information at https://supabase.com/privacy. We are not responsible for the independent acts, omissions, content, or policies of third-party providers except as required by law.

You agree not to misuse the Service. Without limitation, you may not: (a) use the Service if you are under 21 or below the legal drinking age in your jurisdiction; (b) copy, scrape, harvest, or systematically extract data, content, or outputs from the Service; (c) use the Service for commercial resale, competitive analysis, model training, or other commercial exploitation without our prior written consent; (d) interfere with or disrupt the integrity, security, or performance of the Service; (e) reverse engineer, decompile, or attempt to derive source code except where prohibited by law from being restricted; (f) upload unlawful, infringing, harmful, or deceptive content; or (g) use the Service in violation of any applicable law or regulation.

We may investigate suspected misuse and may suspend or terminate access, remove content, or take any other appropriate action in response.

The Service, including the Somlr name, branding, software, interface design, text, graphics, compilations, and other content provided by us, is owned by RBLS LLC or its licensors and is protected by intellectual property and other applicable laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. No rights are granted except as expressly stated in these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. RBLS LLC DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND RELIABILITY.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components, or that any recommendation, extracted text, or other output will be accurate, complete, or suitable for your needs.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RBLS LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF RBLS LLC FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID, IF ANY, TO USE THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US $50).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you to the extent prohibited by law.

You agree to defend, indemnify, and hold harmless RBLS LLC and its officers, members, employees, affiliates, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, your misuse of the Service, or your violation of these Terms or applicable law.

These Terms and any dispute arising out of or relating to the Service or these Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

Subject to applicable law, you agree that any legal action or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time to reflect changes in the Service, our business practices, or legal requirements. When we do, we will revise the "Last updated" date above and may provide additional notice where required by law.

Your continued use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
